  • Ensuring that the voice of the Southern Paiute is included in the District’s planning.

  • Concerns that critical race theory will exacerbate racial divides.

Trustees Heard Update on the Plan for Path Forward Program of Distance Education and Plan for the Safe Return to In-Person Instruction and Continuity of Services

American Rescue Plan (ARP) ESSER requires districts to clarify how local education agencies (LEAs) must meet the statutory requirements to create a plan to safely reopen schools and how SEAs work with LEAs to develop these plans. In accordance with Directive 044, CCSD (an LEA) is required to submit a plan for the safe return to in-person instruction and continuity of services to the Nevada Department of Education (an SEA) by July 14, 2021.By September 10, 2021, CCSD is also required to submit the District’s ARP ESSER Funding Plan.

Highlights of the Plan for Path Forward Program of Distance Education:

  • For the 2021-22 school year, CCSD will be offering three separate learning models to parents/guardians:
    • Full-time face-to-face instruction at every school, with the exception of Nevada Learning Academy which is a virtual school.
    • Full-time distance education at any school with enough participation for the principal to staff the program, and available to all students at Nevada Learning Academy.
    • Hybrid instruction (on a limited basis).
  • All students will be issued a District-owned device, and the District will subsidize Internet connections for eligible families.
  • CCSD will prepare all educators to effectively provide instruction focused on teaching content and language simultaneously during distance education for ELLs.
  • CCSD will provide special education and related services in accordance with each student’s IEP as well as technical assistance to educators to meet the diverse needs of identified students.
  • Students participating in full-time distance education that qualify for FRL may receive meals at school at no cost.

Highlights of the Plan for the Safe Return to In-Person Instruction and Continuity of Services:

  • Masks are required indoors for staff who are not fully vaccinated, students in Grades 4 and 5, and on school buses. Masks are optional for students in Grades 6 through 12 who have been fully vaccinated.
  • CCSD is partnering with community leaders on the Focus on the Future for Kids Community Input Initiative. The first step is to gather community input on the ARP ESSER federal funds provided to CCSD. Input received will provide a community-informed, kids-first agenda to allocate CCSD’s federal funds and other future community investments. The initiative will also establish a new approach to collecting community input and prioritizing the integration of community voices into CCSD’s planning. This process will allow CCSD to prepare and post on the District’s website any revisions to the plan as required by the guidance. Updates will be provided by no later than December 15, 2021, July 15, 2022, December 15, 2022, and July 15, 2023.

Current Registration for the 2021-22 School Year:

  • 95% of currently registered students (or 221,405 students) are registered for face-to-face instruction. The remaining 5% (or 11,853 students) are registered for full-time distance education.
  • The number of registered students is currently trending up by nearly 35,000 over this time last year. A registration influx is anticipated in July and August.

Trustees Heard Update on the 2021 Legislative Session

Trustees received a 2021 Legislative Report following the conclusion of the 2021 Legislative Session. For the first time in over 20 years, all CCSD sponsored bills have passed in a legislative session.

The CCSD bills that passed:

  • SB-2 removes duplicative reporting or tasks that take away from the instructional needs of our children.
  • SB-66 identifies students statewide who lack a digital device or sufficient internet access. This legislation puts Nevada ahead of other states in potentially accessing future federal funds.

Trustees also heard updates on the following:

  • SB-450 will add approximately $3 billion to capital construction to help modernize schools and construct new schools where needed.
  • SB-439 creates a special revenue fund for K-12. All school money will go into a single fund where it cannot be siphoned out for some other purpose.
  • AB-406 will increase funding for K-12 schools.

Education bills that passed:

  • AB-224 creates a pilot program so school districts provide menstrual products in 25% of secondary schools.
  • AB-57 temporarily suspends student learning goals as an evaluation measurement of teachers during the 2021-2022 school with a hold harmless for the current school year.
  • AB-194 requires school districts to hold the appeal process for a suspension or expulsion in an expedited timeline that is to be determined in regulations by the Nevada Department of Education.
  • AB-195 requires school districts to report on the amount of English Learner students and staff in the districts as well as provide the English Learner bill of rights in the primary language of the student and his/her guardian.
  • AB-235 requires school districts to provide two annual events a year to help pupils and parents complete the FAFSA.
  • AB-257 invites school districts to use federal funds to test and repair HVAC units in schools.
  • AB-266 allows teachers to receive extra weights in their evaluation if their class size exceeds recommended class size ratio.
  • AB-371 extends provisions related to bullying and cyber-bullying to additionally prohibit and address discrimination based on race.
  • SB-102 now requires a student to be 5 years old by the first day of school to attend kindergarten starting in the 2022-2023 school year.
  • SB-249 allows students to take mental health days and allows students identification cards to have information for the National Suicide Prevention Lifeline.
  • SB-353 allows the state to audit the amount of testing done at the federal, state and district level and requires school districts to submit a waiver if they would like to conduct additional testing.

Education bills that did not pass: 

  • SB-120 required administrators to reapply for jobs every five years and asked school districts to provide documentation on professional learning.
  • AB-255 and SB-111 created partially appointed school boards.
  • SB-142 removed the ending fund balance protection from collective bargaining from 16.6% to zero; SB439 set at 12%.
  • SB-27 mandated paraprofessionals and coaches to receive a license from the Nevada Department of Education.
  • SB-10 and SB-64 revolved around changes to the property tax structure.

  • Requests to disaggregate MAP and testing data to identify ELLs who are long-term ELLs and/or who have IEPs and 504s.
  • Requests for CCSD to gather information for new incoming students with significant interruptions for formal education.
  • Requests to fix ventilation and filtration systems in schools.

Trustees Approved Proposed Amendments to CCSD Policies and Regulations

  • Policy 4111 – Amendments to Policy 4111 will change the promotion of in-district support professionals to administration positions from a consent item to an informational item. Out-of-district administrators still need to come before the board for consent. Other changes include language cleanup.
  • Regulation 4111 –  Amendments include changes to update and reflect current processes. Some of the changes include outlining the minimum qualifications for licensed administrative positions and professional technical administrative positions; updating language to remove the screening process from an HR function to a committee function; outlining that it is responsibility of the Chief HR Officer to ensure a quality, objective, and fair selection process; and new language indicating that principal selections must follow the process outlined in NRS 388G.740.
  • Regulation 4291 – The amendment contains new language that allows the Superintendent to utilize a full salary schedule to place or advance at-will employees based on their experience, previous salary, and the position requirements. All other changes are primarily cleanup language.
  • Regulation 4360 – Changes will include updates to outdated manual processes that are now facilitated in a human capital management system. All references to the Superintendent being responsible for any part of the resignation process have been removed and replaced with the Chief HR Officer designation.

Trustees approved all motions to pass the policy and regulation amendments 6-0, with one trustee not present to vote.

Trustees Submitted Requests for Future Board Items:

  • Presentation from the Bond Oversight Committee
  • A work session on AB-495 to discuss the Legislative Committee on Education Study and how the District would like to help the committee ensure that their concerns are addressed
  • A work session with NASB (Nevada Association of School Boards) to discuss some of the ongoing work that NASB is doing at the state level, ground in the role of the Board of Trustees, and educate incoming legislatures.

Members of the public commented in-person, through voice recorded messages, and written public comment on non-agenda items regarding: 

  • Concerns about the health and safety of teachers and specialists returning to school buildings
  • Concerns that an agreement for specialists that facilitate Art, Music, Library, P.E., S.T.E.A.M., etc. is not being honored by CCSD 
  • Concerns that specialists are not being allowed to follow an MOA to teach in their content areas
  • Concerns that the district’s policy of random, mandatory COVID-19 testing limits access to testing for some staff
  • Concerns about employee morale
  • Concerns that an anti-racism and anti-bias policy has not been added to a CCSD Trustee meeting agenda
  • The need to address racial issues and restoration in West Las Vegas

Trustees Approved Consent Agenda With Adjustments

Trustees approved the consent agenda (6-0) with the deletion of agenda item 3.03 regarding Professional Services: Title IV, Part A Grant, Nevada Department of Education. One trustee was not present to vote.

Consent Agenda Highlights: 

  • Addendum to the Memorandum of Agreement between CCSD and Eye Care 4 Kids to extend access to school-based vision services to siblings under 18 years of age who reside with students enrolled in CCSD
  • Authorization to accept additional grant funding for The Social Workers in Schools grant project in the amount of $3,451,747.57 from the Nevada Department of Education to provide added social work and mental health support services to schools for a total grant amount of $17,193,033.37 
  • Purchase awards totaling $2,151,531.32
  • Authorization to extend the Contract for Services for Thunder Road Productions/Commercial Talent Agency to host 20 episodes of the Vegas PBS series Outdoor Nevada 

Trustees Heard Update on 2021 Budget 

The 2021 Amended Final Budget forecast has not changed since the Board was last updated at the February meeting. The forecast focuses on the ending fund balance which indicates CCSD’s anticipated reserves. Additional budget updates include:

  • Revenues have declined due to a decrease in enrollment and this has been taken into consideration for the budget.
  • CCSD is experiencing significant savings in all areas, including payroll, supplies, and services. This is primarily in school budgets–school carryover supplies, service level agreements (SLAs), and vacancy savings are now anticipated to be approximately just over $200 million in restricted fund balance.
  • The potential revenue shortfall due to lower than anticipated costs throughout the year is approximately $43.3 million. 
  • The unassigned fund balance is still at $54.3 million which is 2.25% of the revenues.

The district still anticipates significant fiscal impacts due to the pandemic. Uncertainties related to COVID-19’s impact on the budget persevere, including possible impacts of a recession and enrollment uncertainties. State funding reductions have been incorporated into the budget for this year, with additional anticipated changes going into next year.

CCSD has been allocated approximately $374 million through ESSER II federal funding. The district is working to prioritize the use of those funds in anticipation of any funding changes from the state as well as address additional needs related to COVID-19 and reopening schools.

CCSD has not received a final allocation for the newest round of federal funding through the American Rescue Act. Trustees will be provided with an update when more information on those funds becomes available.

Board Heard Update on Proposed Charter Schools

Trustees heard a briefing on the collaborative efforts between the State Public Charter School Authority (SPCSA) and CCSD. The genesis of this collaborative effort was the passage of Assembly Bill 462 in 2019 which mandates that the SPCSA collaborate with districts in which they are planning to place or expand charter schools. Under the bill, the SPCSA must notify the district when the following occurs:

  • A group of individuals submits an Intent to Apply to become a charter school
  • A group of individuals submits an application to operate a charter school
  • A school that is currently in operation submits a request to the SPCSA to amend its current charter contract

SCPSA assesses proposed schools based on six criteria: Demographics, Academic Geographics, Social-Emotional, Academic Learning Models, Financial Plan, and Successful History. Schools must meet standards in all six categories to receive approval to operate a charter school in Nevada.  In February 2021, SPCSA provided applications to CCSD for review and feedback on the following proposed public charter schools:

  • Battle Born Academy
  • PilotED Schools of Nevada
  • OLAM Academy of Nevada (OLAM Academy has recently withdrawn its application for consideration. CCSD anticipates that OLAM will reapply in one year.)

CCSD will submit its assessment questionnaires back to the SCPSA this month. In April 2021, the SPCSA staff will submit its recommendation to the SCPSA board for their approval or denial of the applications. In May 2021, the SPCSA will notify the public and the Nevada Department of Education regarding its decisions.

Trustees approved a motion (6-0) accepting a recommendation not to approve the proposed charter school applications. One trustee was not present to vote.

Trustees Approved Notice of Intent to Amend CCSD Regulation 6150 Regarding Instructional Materials and Services

The CCSD K-12 Literacy and Language Development Department convened a task force representing all regions and Trustee districts to provide recommendations for the amendment of Regulation 6150, which provides guidance on the selection and provision of instructional materials and services. The task force is made up of region superintendents, school associate superintendents, principals, teachers, teacher librarians, and central office staff, including the Office of General Counsel, Human Resources, and the Equity and Diversity Education Committee.

Reasons for amendment of Regulation 6150 include:

  • Clarification of ambiguous language defining instructional materials
  • Better defined procedures for the selection of supplemental textbooks
  • The need to address school library staffing, reporting, and resources as approved in the amendment of CCSD Regulation 6161

Members of the public submitted comment in support of Regulation 6150.

Trustees passed a motion (6-0) to approve the Notice of Intent to amend CCSD Regulation 6150. One trustee was not present to vote.

Board Heard Update on 2021 Legislative Session

As of March 25, 2021, 799 bills have been introduced in the Nevada Legislature, of which CCSD is tracking 265. CCSD staff noted that the deadline for bill introductions has been extended past March 26. By April 9, all bills must pass the committee in the house in which they were introduced. District staff provided an overview of bills that have been introduced in their respective committees: 

  • Senate Bill 102: SB102 changes the date by which a child is required to be five years old to attend kindergarten.
  • Senate Bill 173: SB173 invites schools to submit a plan to address learning loss by offering free summer school to students.
  • Senate Bill 182: SB182 requires P.E. instruction to include activities scientifically shown to reduce obesity.
  • Senate Bill 202: SB202 requires school districts to count credits in computer coding as a foreign language credit.
  • Senate Bill 220: SB220 requires school districts to establish alternative education opportunities for students to receive elective course credits after the state has identified apprenticeship programs that have certain exemptions.
  • Senate Bill 272: SB272 establishes the Nevada Educator Core where NDE will form a database of available tutors to provide in-person or online tutoring for public schools.
  • Assembly Bill 67: AB67 makes some changes to the restorative justice bill passed in 2019.
  • Assembly Bill 194: AB194 seeks to address the timelines for students appealing a suspension or expulsion.
  • Assembly Bill 195: AB195 establishes an English Language Learner Bill of Rights.
  • Assembly Bill 215: AB215 allows a 17-year-old to earn a diploma through adult education if they attended high school for four years but were credit deficient.
  • Assembly Bill 262: AB262 grants in-state tuition for Native American students. 
  • Assembly Bill 265: AB265 provides an alternative route to licensure for the educational administrative pathway.
  • Assembly Bill 319: AB319 allows the College of Southern Nevada (CSN) to enter into a cooperative agreement with CCSD for a pilot program targeting populations in under-resourced communities for expanded opportunities in dual enrollment credit courses.

Board Approves Resolution to Oppose Appointed School Boards

Assembly Bill 255 (2021) seeks to change the method by which the board of school trustees is chosen from an elected method to a hybrid elected and appointed method. Trustees approved a motion 6-0 opposing changes to the method by which the board of trustees is chosen. One trustee was not present to vote.

Board Approved Consent Agenda 

Highlights include: 

Trustees Approved Rescinding Name of Kit Carson Elementary (5-1)

This is the first school name change under the updated School Naming Policy, approved by Trustees in May 2019. Trustees discussed the social implications of removing the name Kit Carson Elementary School, citing historical facts about Kit Carson’s actions. Trustees also discussed the financial implications of the name change, which is anticipated to range between $26,000-$40,000. The approved motion to rescind the school name includes partnering with the community and district to assist with the funds needed to implement the changes. The motion passed 5-1, with one Trustee not present for the vote.

Trustees Postponed Title IX Amendment Resolution (4-2-1)

On May 6, 2020, the United States Department of Education released updated regulations related to sexual harassment. CCSD must demonstrate compliance with these updated regulations in order to receive federal education funding, which includes Title I and Special Education. The resolution, if signed, is a commitment that CCSD intends to be in compliance with federal law and implement the necessary regulation changes. To date, CCSD has implemented some changes in order to be in “minimal compliance” with the regulations, including public notices and notifications to employee groups. There is no federal deadline for updating regulations and implementing changes. 

Some trustees shared their concerns with the implications of the updated regulations for victims and alleged perpetrators. Based on this, Trustees voted to postpone their decision to sign the resolution for at least two weeks in order to identify any possible avenues to prevent making the changes. The vote passed 4-2, with one abstention.

Trustees Approved Memorandum of Agreement with CCEA 

The agreement with the Clark County Educators Association (CCEA) extends the ability of employees to “donate” unused sick leave to other employees impacted by COVID-19 through the end of the 2020-2021 school year. The agreement was originally put into place at the April 16, 2020 Trustee meeting

Board Heard Updates from Superintendent Jara: 

  • Superintendent Jara welcomed new principals at R. Guild Gray Elementary School, Lois and Jerry Tarkanian Middle School, Steve Cozine Elementary School, and Don E. Hayden Elementary School. 
  • 98.73% of enrolled students have been marked present since the beginning of the school year. 
  • CCSD is unaware of the device and internet connectivity status of approximately 25,000 students.

Can community members engage at Trustee Meetings? Decision-making bodies benefit greatly from hearing public input and multiple perspectives. Community members can sign up to speak after the agenda has been posted– by calling the Board Office at (702) 799-1072 at least 3 hours before the scheduled meeting, or signing up in-person at the beginning of the meeting. Prior to each agenda item being voted on, speakers can share their perspective after the Board’s discussion and prior to the vote.

Public Comment

Members of the public provided testimony to Trustees regarding:

  • Concerns about students not getting enough physical activity, recess, and restroom breaks throughout the school day
  • Concerns about school safety and controlled access to school buildings
  • Appreciation for the district from a representative of the Education Support Employees Association (ESEA) for hearing support staff concerns while a Memorandum of Understanding was developed
  • Concerns about a student getting expelled for bringing foam toy nunchucks to school
  • Concerns about the process for hiring educators
  • Difficulty accessing pre-K for students who are not English Language Learners 
  • Concerns about a lack of training and professional development for support staff

Teachers, Principals and Staff: Human Resources

  • Objective 1: Increase the percentage of licensed teachers in the classroom.

Members of the public provided testimony regarding funding for teacher pay and benefits to attract and retain teachers. Trustees discussed capturing teacher attrition data through an exit survey process. Trustees also discussed focusing on areas like school culture and professional development to support educator retention. 

Sound Fiscal Management: Out-of-Service Buses and Bus Driver Absenteeism

  • Objective 1: Reduce number of buses placed out-of-service to reduce service delays.
    • Goal (2019-20): 21%
    • Actual (2018-19): 19% 
    • By 2024: 3%
  • Objective 2: Reduce bus driver absenteeism to improve service to students and ensure full instructional minutes.

Approaches to prevent chronic absenteeism of bus drivers included:

  • Recognizing employees quarterly for perfect attendance
  • Educating drivers and staff about how student achievement is impacted by their attendance.
  • To reduce driver absenteeism caused by health-related matters, the transportation department also implemented health and prevention initiatives, such as partnering with Medicine on the Move (over 118 transportation employees received treatment so far). 

Sound Fiscal Management: Purchasing

  • Objective 1: Decrease processing time, reduce costs, and increase the competitive procurement ratio.

  • Objective 2: Reduce requisition processing time by increasing SAP catalog utilization to 70% within the next five years.

Trustees discussed direct, school-level purchasing versus centralized purchasing. Centralizing purchasing for the district tends to be more cost-effective.

Trustees Approved the Consent Agenda

Trustees Heard a Presentation on the Eide Bailly Internal Controls Exam Report

A representative of Eide Bailly’s forensic department presented an overview of its report of CCSD’s Internal Controls examination. 

The primary examination method used was holding interviews with 409 CCSD employees within various business and finance units as well as some schools. 

Following the interviews, 13 recommendations were made for the district.

Trustees discussed staff training to ensure school-level compliance with updated policies and procedures. A request was made for Trustees to receive regular updates on each recommendation.

Trustees Heard a Presentation on Open Book Website

Open Book makes CCSD financial information easily accessible to the public. 

The Open Book website includes access to external audit results, the final budget of the fiscal year, and videos explaining topics related to the District’s finances. The site also has tools that show strategic budgets by school and accounts payable (payments to vendors).

There will be a Facebook Live video walk-through of Open Book on October 8th from 4:00-6:00 PM.

Trustees Approved a Memorandum of Agreement (MOU) Between CCSD and the Education Support Employees Association (ESEA)

One member of the public provided testimony in support of increased pay for support staff.

The agreement includes a 3% salary increase and a waiver for required fingerprinting costs.

The ESEA requested time to communicate the contract terms to the employees that will be impacted. Trustees approved the 2019-2021 MOU pending ratification. Once the ratification vote is made, it was requested that the pay increases be reflected in pay checks as soon as possible.

Trustees Approved Changes to Food Service Programs Regulations

Trustees approved minor language updates to the Food Service Programs regulations.

Trustees Approved Changes to the School Facilities Naming Regulations (6-1 vote)

Trustees approved updates to the School Facilities Naming policy regulations. An eligible school that chooses to be renamed must conduct a survey of employees and families. At least 50% of the surveys must be returned, and greater than 50% of the surveys returned must agree to renaming the school.

Trustees approved the changes with a request for clarification that additional community input outside of the school community can be gathered for consideration, but will not be counted towards the 50% survey requirement. It was also requested to include examples of types of stakeholders that input could be gathered from.

Trustees Approved Changes to the 2021-2022 School Year Calendars for Students and Staff (5-2 vote)

The most significant change was related to how professional development is accounted for. Beginning in the 2016-2017 school year, schools were permitted to bank time for professional development in more flexible and frequent increments. Site-based collaboration was able to be banked and later utilized as time off during the week of Thanksgiving. This approach was approved by the Department of Education through the 2019-2020 school year. 

For the 2021-2022 school year, the Monday and Tuesday of Thanksgiving week are now in-school days, and there are four days spread out throughout the year that are dedicated to professional development.

Members of the public expressed concerns about:

  • Student absenteeism the week of Thanksgiving due to travel schedules
  • Students and staff having the full week of Thanksgiving dedicated to spending time with families.
  • A disproportionate amount of work days being taken away from 9-month support staff. 

Contingency days were also set for March 9th, April 13th, and May 21st. 

The calendar was informed by a committee consisting of over 25 stakeholders including principals, counselors, and other staff from other departments such as transportation and HR.

Trustees Approved Renaming Lomie G. Heard Elementary School, A Marzano Academy, to Lomie G. Heard Elementary School

The name change was to remove the “Marzano Academy” component of the name, since the school’s contract with Marzano is no longer active. 

Trustee Reports:

  • Trustee Wright hosted a Facebook Live parent meeting as a way to be more accessible to parents who cannot attend meetings at set times in person. 
  • Trustee Young announced an upcoming Cultural Food Festival for families in partnership with Vegas PBS this Fall. Additionally, October 18-19th is the Las Vegas Book Festival.
  • Trustee Ford holds monthly parent meetings and live stream videos on topics such as navigating meeting agendas. 
  • Cepeda announced that FAFSA releases on October 1st. 
  • NABSA strategic planning Friday and Sat to discuss collaboration throughout the stat and advocating for common sense policies.
  • Trustee Brooks served on a panel for Opportunity 180 that also included Superintendents Ebert and Jara, J.T. McWilliams Principal Womack, Caryne Shea from HOPE for Nevada– to talk about what it would take to make some systemic changes to focus on student outcomes. 
  • Trustee Young expressed concerns about 3 school principals that were removed for not meeting student growth benchmarks.
